About the proposal
We are seeking feedback from local residents, on the proposal to enter into a road closure process for a portion of Hamley Street, Peterhead measuring approximately 129sqm which is adjacent a number of residential properties. If this small portion of road is approved for closure, this land will be closed and disposed of and amalgamated into the adjoining property owners' allotments.
We were approached by one of the registered owners on Mead Street, Peterhead to advise they had commissioned a survey of their residential allotment. This survey confirmed that a portion of land on which the owner had constructed a large carport and shed is included within their allotment. Currently, however, this portion of land extends beyond the fence line at the rear of the property adjoining the west side of Hamley Street.
The Surveyor General has now confirmed the findings of this survey. The Surveyor General has also indicated that:
- Historically, this portion of the land had been allocated under common law precedent as a road rather than as private land, which is why it had been placed under Council ownership.
- Similar portions of land also exist at the rear of 112, 114, 116, 118, 120, 122 and 124 Mead Street, Peterhead, all of which also adjoin the west side of Hamley Street.
We have since received a request from the owners of 112, 114, 116, 118, 120, 122 and 124 Mead Street, Peterhead, to correct this historical fencing alignment error.
Preliminary Plan
The specific portion of land that the owners of the above properties have requested to acquire is identified as ‘Road’ and known as Hamley Street, Peterhead. For Council to consider this proposal, the Road Closure Process must be entered into to first close the portions of land, defined as “road’ and that have been requested to be transferred to the adjoining owners.
The total portion of ‘Road’ proposed to be closed (spanning over 7 separate residential allotments) measures approximately 129sqm. Please see the Preliminary Plan below for more information.
A copy of the Preliminary Plan and statement of persons affected are available for public inspection at the City of PAE’s Civic Centre located at 163 St Vincent Street Port Adelaide SA 5015 between the hours of 8.30am and 5.00pm, Monday to Friday.

Making an objection
Any person affected by the proposed closure is entitled to object or to apply for an easement to be granted in that person’s favour over the land subject to the proposed closure.
If you wish to make an objection, you must do so in writing to the City of PAE.
Please either post your objection to PO Box 110, Port Adelaide SA 5015 or email it to consultation@cityofpae.sa.gov.au within 28 days of the date of the notice published in the South Australian Government Gazette and forward a copy of the objection or application to the Surveyor-General at GPO Box 1815, Adelaide SA 5001 or DTI.RoadOpeningClosing@sa.gov.au, within the same time period.
